STATEMENT ON DIGITAL RIGHTS FOR
\nPROTECTING MEMORY INSTITUTIONS ONLINE<\/p>\n

Purpose:<\/p>\n

In recognition of the irreplaceable value that libraries, archives, and
\nmuseums (hereinafter \u201cmemory institutions\u201d) bring to the public, this
\ndocument articulates the essential activities in archival collection,
\npreservation, and lending that need protection and support in today\u2019s digital
\nmedia environment. Together, the signatories call upon policymakers and
\ncommunities to ensure memory institutions retain the same rights and
\nresponsibilities online that they have enjoyed offline.<\/p>\n

Background:<\/p>\n

Memory institutions support communities by preserving and providing long-
\nterm access to the cultural, artistic, and scientific knowledge that make up
\nour collective intellectual heritage. Memory institutions also help individuals
\nseeking, obtaining, and sharing information by democratizing access and
\nallowing everyone\u2014no matter their income level or physical location\u2014to
\neducate themselves and participate in public life. Authors, researchers,
\njournalists, and other creators depend upon digital access to library,
\narchive, and museum collections, because these memory institutions keep
\nresources available without regard to commercial viability. Future
\ngenerations depend upon memory institutions for access to the older,
\ndifficult-to-find materials that become building blocks for new creative
\nworks and scientific understanding.<\/p>\n

These essential public benefits are possible because memory institutions
\nhave historically had the discretion and capacity to collect, preserve, and
\nprovide controlled access to books and other essential resources.
\nUnfortunately, many of these activities have become less certain in today\u2019s
\nincreasingly digital, networked world. On the one hand, much of the world\u2019s
\ninformation remains undigitized in physical formats and thereby
\ninaccessible to those without time and resources to travel. On the other
\nhand, many of the materials that are published and accessed online in
\ndigital formats are locked up in commercial platforms that unduly restrict
\nmemory institutions in their public service mission. This state of affairs has
\nleft memory institutions with fewer (if any) practical ways to collect,
\npreserve, and make materials available for future generations.<\/p>\n

Principles:<\/p>\n

Simply put, the rights and responsibilities that memory institutions have
\nalways enjoyed offline must also be protected online. To accomplish this
\ngoal, libraries, archives and museums must have the legal rights and
\npractical ability to:
\n\u2022 Collect materials in digital form, whether through digitization of
\nphysical collections, or through purchase on the open market or by
\nother legal means;
\n\u2022 Preserve digital materials, and where necessary repair, back up, or
\nreformat them, to ensure their long-term existence and availability;
\n\u2022 Provide controlled access to digital materials for advanced
\nresearch techniques and to meet patrons where they are\u2014online;
\n\u2022 Cooperate with other memory institutions, by sharing or
\ntransferring digital collections, so as to aid preservation and access.
\nFor memory institutions to realize their full potential in today\u2019s digital world,
\nthey cannot be subject to undue burdens or predatory contracts stifling their
\ncollection and preservation efforts. And these institutions must be protected
\nfrom destruction by excessive financial attacks and operational
\nrestrictions.<\/p>\n

We, the undersigned, hereby call upon policymakers worldwide to secure
\nthe essential public role of libraries, archives, and museums and to adopt
\nthese principles wherever possible into local, regional, and national laws.<\/p>\n
